These Terms and Conditions (“Terms”) govern your access to and use of davesellspalmcoast.com (the “Site”) and the services offered through it (the “Services”). The Site is operated by Dave Pilvinsky, a licensed Florida real estate professional, in affiliation with Florida Beaches Real Estate Company (“FB Real Estate Co.”) (collectively, “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

1. Eligibility and Acceptance

You must be at least 18 years old and able to form a binding contract to use the Site. By using the Site, you represent that you meet these requirements and that the information you provide is accurate and complete.

2. About Our Services

The Site provides real estate information, property search, home valuation tools, and a way to contact us about buying or selling property in Palm Coast, Flagler County, and surrounding areas of Florida. All real estate brokerage services are provided through:

Using the Site does not create a brokerage, agency, or fiduciary relationship between you and us. A real estate agency relationship is created only by a separate written agreement that complies with Florida law.

3. Property Listings, IDX, and MLS Data

Property listing information on the Site is provided in whole or in part through the Internet Data Exchange (IDX) program of Stellar MLS (My Florida Regional MLS, Inc., dba Stellar MLS), displayed on behalf of Florida Beaches Real Estate Company under a Stellar MLS Third Party Data Access Agreement. You acknowledge and agree that:

• Listing data is owned by Stellar MLS and the participating brokers and is protected by copyright and other intellectual property laws.
• IDX listing data is provided exclusively for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify prospective properties you may be interested in purchasing.
• Listing information is deemed reliable but is not guaranteed accurate by Stellar MLS, the listing broker, or us. You should independently verify all information, including square footage, lot size, taxes, schools, zoning, HOA details, and property condition.
• Listings may be subject to prior sale, change, or withdrawal without notice, and may not reflect all properties available through Stellar MLS or all real estate activity in the market.
• Certain listings and listing details may be excluded or suppressed in accordance with Stellar MLS rules.

You agree not to copy, scrape, harvest, reproduce, distribute, or create derivative works from any listing data except as expressly permitted by Stellar MLS rules.

All listing information is deemed reliable but not guaranteed and should be independently verified through personal inspection by appropriate professionals. Listings displayed may be subject to prior sale or removal from sale, and the availability of any listing should always be independently verified. Listing information is provided for consumers’ personal, non-commercial use, solely to identify potential properties for potential purchase; all other use is strictly prohibited and may violate relevant federal and state law.

4. Home Valuation Tools

Any automated home value estimate, market analysis, or valuation provided through the Site is an estimate only, generated from available data and algorithms. It is not an appraisal, not a comparative market analysis (CMA) prepared by a licensed professional, and not an offer to purchase. Actual property value can only be determined by a licensed appraiser or through a formal market analysis. Do not rely on any automated estimate for financial, lending, tax, or legal decisions.

5. Accounts and Registration

Some features require you to register and create an account. You agree to provide accurate information, keep your credentials confidential, and accept responsibility for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

6. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Scrape, crawl, data-mine, or use bots or automated means to access listing data or other content except as expressly permitted
• Reproduce, resell, or commercially exploit any part of the Site or its content
• Interfere with or disrupt the Site, its servers, or its security features
• Upload viruses, malware, or harmful code
• Impersonate any person or misrepresent your affiliation
• Harvest or collect information about other users
• Use the Site to send spam or unsolicited communications

7. Communications Consent

By submitting your contact information through the Site, you consent to be contacted by us and by FB Real Estate Co. by phone, text message, and email as described in our Privacy Policy. Consent to marketing communications is not a condition of any purchase. You may unsubscribe from emails using the link in any message.

SMS Messaging Terms

Dave Sells Palm Coast sends transactional messages relating to your property enquiry, including showing confirmations, scheduling, and follow-up, and, where you have separately consented, marketing messages including new listing alerts, open house invitations, and Palm Coast market updates.

Mobile phone numbers and SMS consent are not shared, sold, rented, or transferred to any third party or affiliate for any purpose other than delivering the messages you have consented to receive.

Carriers are not liable for delayed or undelivered messages. You are responsible for any carrier charges you incur and for keeping your contact details accurate. Full details of how we handle your information are set out in our Privacy Policy.8. Intellectual Property

Except for MLS/IDX listing data (which is owned by the applicable MLS and brokers) and other third-party content, all content on the Site — including text, graphics, logos, images, page design, and software — is owned by or licensed to us and is protected by copyright, trademark, and other laws. You may view and use the Site for your personal, non-commercial purposes only. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

9. Copyright Complaints (DMCA)

We respect the intellectual property rights of others. If you believe content on the Site infringes your copyright, please send a written notice to our designated agent that includes: (1) your signature (physical or electronic); (2) identification of the copyrighted work claimed to be infringed; (3) identification of the allegedly infringing material and its location on the Site; (4) your contact information; (5) a statement that you have a good-faith belief that the use is not authorized; and (6) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the owner.

10. Fair Housing

11. Third-Party Links and Services

The Site may link to or integrate third-party websites, tools, and services (for example, mapping, mortgage calculators, lenders, and analytics providers). We do not control and are not responsible for the content, accuracy, or practices of those third parties. Your use of third-party services is governed by their own terms and policies.

12. Disclaimers

THE SITE AND ALL CONTENT, LISTINGS, AND TOOLS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that any information (including listing data and valuations) is accurate, complete, or current. Any reliance you place on Site content is at your own risk. Nothing on the Site constitutes legal, financial, tax, appraisal, or investment advice.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, FB REAL ESTATE CO., OR OUR AGENTS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ANY LISTING DATA OR TOOLS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred dollars ($100.00). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Dave Pilvinsky, FB Real Estate Co., and our agents, affiliates, and service providers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Flagler County, Florida, and you consent to the personal jurisdiction of those courts.

16. Changes to These Terms

We may modify these Terms at any time by posting the revised version on the Site and updating the “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

17. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Site.
