This Privacy Policy describes how Dave Pilvinsky, a licensed real estate professional affiliated with Florida Beaches Real Estate Company (“FB Real Estate Co.”) (collectively, “we,” “us,” or “our”), collects, uses, and shares information about you when you visit davesellspalmcoast.com (the “Site”) or otherwise interact with our real estate services (collectively, the “Services”).

By using the Site, you agree to the collection and use of information in accordance with this Policy. If you do not agree, please do not use the Site.

1. Who We Are

The Site is operated by Dave Pilvinsky, a real estate licensee in the State of Florida, in affiliation with:

2. Information We Collect

Information you provide to us directly. When you fill out a form, register for an account, save a property search, request a home valuation, schedule a showing, or otherwise contact us, we may collect:

• Name, email address, phone number, and mailing address
• Property preferences, search criteria, and saved listings
• The address of a property you ask us to value, and details you provide about it
• Budget, timeline, financing status, and other details relevant to a home purchase or sale
• Any messages, comments, or other content you submit

Information collected automatically. When you use the Site, we and our service providers may automatically collect:

• IP address, browser type, device type, and operating system
• Pages viewed, links clicked, listings viewed, and time spent on the Site
• Referring website and search terms that brought you to the Site
• Session activity, including mouse movements, scrolling, and clicks, captured through analytics and session-replay tools
• Geographic/location information derived from your IP address

Information from third parties. We may receive information about you from real estate listing services (MLS/IDX providers), lead-generation partners, our customer relationship management (CRM) platform, social media platforms, and other service providers, and combine it with information we already hold.

3. Cookies and Tracking Technologies

We use cookies, web beacons, pixels, local storage, and similar technologies to operate the Site, remember your preferences and saved searches, analyze traffic, and measure the performance of our marketing.

We may use analytics and session-recording services (for example, Google Analytics and Microsoft Clarity) and advertising tools (for example, Google Ads and Meta/Facebook pixels) that set their own cookies and collect usage data subject to their own privacy policies.

You can usually set your browser to refuse cookies or alert you when cookies are being sent. Some features of the Site may not function properly without cookies. You can also opt out of certain advertising cookies through tools such as the Digital Advertising Alliance (optout.aboutads.info) and the Network Advertising Initiative (optout.networkadvertising.org).

4. How We Use Your Information

We use the information we collect to:

• Respond to your inquiries and provide property information, valuations, and listings
• Contact you about properties, market updates, and services that may interest you
• Create and manage your account and saved searches
• Send you marketing communications, newsletters, and promotional messages (where permitted)
• Personalize your experience and the content and listings you see
• Analyze usage, measure advertising performance, and conduct research
• Detect, prevent, and address fraud, security issues, and technical problems
• Comply with legal obligations and enforce our Terms and Conditions

5. Text Messages and Phone Calls (SMS/Calls)

When you provide your mobile number and opt in to receive text messages from Dave Sells Palm Coast, the following terms apply.

Program description
Dave Sells Palm Coast, the real estate practice of David Pilvinsky at FB Real Estate Co., sends two types of SMS messages: (1) transactional messages relating to your property enquiry, including showing confirmations, scheduling, and follow-up on your request; and (2) marketing messages, including new listing alerts, open house invitations, and Palm Coast market updates. You consent to each message type separately, and you may consent to one without the other.

Consent
By providing your phone number and submitting a form or otherwise requesting contact, you consent to receive calls and text messages (SMS/MMS) from us and from FB Real Estate Co., including through an automatic telephone dialing system or prerecorded or artificial voice, at the number you provide, for real estate, transactional, and marketing purposes. Consent is not a condition of purchasing any property or service, and SMS consent is not required in order to submit any form on this site.

Message frequency
Message frequency varies based on your enquiry and your engagement with us. You may receive a few messages per week.

How to opt out
You can opt out of SMS messages at any time by replying STOP to any message. After replying STOP you will receive one final confirmation message and will not receive further SMS messages from us. You may opt out of marketing calls by telling us during any call, or by using the contact details at the end of this section.

Mobile information sharing
Dave Sells Palm Coast does not share, sell, rent, or transfer mobile phone numbers or SMS consent to any third party or affiliate for any purpose other than delivering the messages you have consented to receive. Mobile phone numbers and SMS consent are never sold or shared for marketing or promotional purposes. This exclusion applies to every category of recipient listed in How We Share Your Information, including FB Real Estate Co. and affiliated agents, MLS and IDX providers, transaction partners, advertising vendors, and lead-management vendors. Where a messaging provider processes your number in order to send these messages on our behalf, it is contractually prohibited from using it for any other purpose.

Carriers
Carriers are not liable for delayed or undelivered messages.

6. IDX / MLS Property Search

The Site displays property listings through the Internet Data Exchange (IDX) program of Stellar MLS (My Florida Regional MLS, Inc.). Listing data is owned by Stellar MLS and participating brokers and is provided for consumers’ personal, non-commercial use.

When you search listings, save properties, or register on the Site, your registration and activity information may be shared with the listing brokerage, Stellar MLS, and our IDX data vendor in accordance with their rules and policies. Listing information is deemed reliable but is not guaranteed accurate. See our Terms and Conditions for additional MLS/IDX terms.

7. How We Share Your Information

Mobile information and SMS consent. Mobile phone numbers and SMS consent are excluded from every form of sharing described in this section. We do not share, sell, rent, or transfer mobile phone numbers or SMS consent to any third party or affiliate for any purpose other than delivering the messages you have consented to receive, and they are never sold or shared for marketing or promotional purposes. This exclusion applies to all categories below, including our brokerage and affiliated agents, service providers, MLS and IDX providers, transaction partners, legal and safety recipients, and business transfer recipients. All other personal information. Subject to the exclusion above, we may share your personal information as follows:

• Our brokerage and affiliated agents — FB Real Estate Co. and licensed agents who assist with your real estate needs
• Service providers — We may share personal information with companies that perform services on our behalf, such as CRM, email, hosting, analytics, advertising, and lead-management vendors. These providers are required by contract to use the information only to perform services for us and to keep it confidential. Mobile phone numbers and SMS consent are shared only with the messaging providers that deliver the text messages you have consented to receive, and are not shared with any other service provider, advertising vendor, or lead-management vendor.
• MLS and IDX providers — as described in Section 6
• Transaction partners — when you choose to work with us, parties such as lenders, title companies, inspectors, and cooperating brokers, with your direction or consent
• Legal and safety — when required by law, subpoena, or legal process, or to protect our rights, property, or safety, or that of others
• Business transfers — in connection with a merger, acquisition, or sale of assets

Some sharing for targeted advertising or analytics may be considered a “sale” or “sharing” under certain state privacy laws. See Section 9 for your choices.

8. Data Retention and Security

We retain personal information for as long as needed to provide the Services, comply with our legal obligations (including real estate recordkeeping requirements), resolve disputes, and enforce our agreements.

We use reasonable administrative, technical, and physical safeguards to protect your information. However, no method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security.

9. Your Privacy Rights

Depending on where you live, you may have the right to:

• Request access to the personal information we hold about you
• Request correction of inaccurate information
• Request deletion of your personal information
• Opt out of the “sale” or “sharing” of your personal information and targeted advertising
• Opt out of marketing communications at any time
• Not be discriminated against for exercising your rights

To exercise any of these rights, contact us using the details in Section 11. We may need to verify your identity before responding. You may also designate an authorized agent to make a request on your behalf.

California residents: Under the CCPA/CPRA, you have the rights described above. We do not knowingly sell the personal information of consumers.

“Do Not Track”: Some browsers offer a “Do Not Track” signal. Because there is no common industry standard, the Site does not currently respond to those signals. We do honor recognized opt-out preference signals where required by law.

10. Third-Party Links

The Site may contain links to third-party websites, tools, and services that we do not control. This Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party site you visit.

11. Children’s Privacy

The Site is not directed to children under 13 (or under 16 where applicable), and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can delete it.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Policy.
